Profile:

Linda Emery's practice primarily involves the transactional and dispute resolution aspects of construction law.  She has represented public and private owners, contractors, subcontractors, suppliers, EPC firms, and sureties on substantial construction projects, including schools, hospitals, commercial offices, governmental facilities, hotels, underground utility projects, pipelines and cogeneration plants.  Her experience includes prosecution and defense of a variety of construction-related issues, including disputes involving mechanic' liens, payment and performance bonds, bid protests, defective construction, changed conditions and project delays.  Ms. Emery also has extensive experience in claim analysis, and drafting and reviewing construction contracts, purchase orders, subcontracts, master agreements and related documents.

Representative Experience:
  • Drafted owner/contractor agreement for a national restaurant/entertainment chain.
  • Revised Invitation to Bidders, Standard Form of Agreement, General Conditions of Agreement, and Payment and Performance Bond forms for a Texas municipality
  • Assisted in representation of general contractor on a multi-million-dollar arbitration claim for extra work, changed work and delay/impact damages arising out of changed conditions and deficient design and construction administration for the renovation of a historic building into a high-rise hotel and apartments.
